Terms of Use
Agreement and Operator
These Terms form an agreement between you and the individual developer identified as the Seller on Mivo’s App Store product page (the “Developer,” “Mivo,” “we,” or “us”). By tapping “Continue with Apple,” creating a Mivo account, or continuing to use the App after these Terms are presented, you agree to them and acknowledge the Privacy Policy. If you do not agree, do not sign in or use Mivo. You must be at least 13 and legally able to agree; if you are under the age of majority where you live, a parent or guardian must approve your use.
1. Service and Account
Mivo is a local-first photo memory and organization tool. It helps you revisit photos and videos, save meaningful items, review possible cleanup candidates, and optionally discuss a photo with AI. Mivo is not a cloud photo library. Sign in with Apple is the only account method and is used for sessions, subscription entitlement, usage limits, account deletion, and limited cross-device AI memory. Keep your device and Apple Account secure. You may not transfer, sell, or misuse your account or service credentials.
2. Your Library and Content
You and the relevant rights holders keep all rights in your photos, videos, messages, and other content. Mivo does not claim ownership. You give Mivo a limited, non-exclusive, purpose-bound permission to access, copy, transmit, transform, and process content only as needed to provide features you request, secure the service, comply with law, and maintain the limited AI memory described in the Privacy Policy. This permission ends when the relevant content is deleted or no longer needed, subject to reasonable backups, security records, provider retention, and legal obligations. When a photo includes another person, use AI only when you have a lawful basis or appropriate permission to submit it.
3. AI and Third-Party Processing
AI is optional. Before the first AI request, Mivo asks for separate permission to share the disclosed data. For a photo you deliberately submit, Mivo sends a reduced JPEG copy and limited contextual clues through its encrypted gateway to Alibaba Cloud Model Studio’s Qwen service for a text visual summary. Mivo then sends that summary, prompts, the current conversation, and selected memory or profile clues to the DeepSeek API for replies and memory distillation; DeepSeek does not receive the photo copy. International processing may occur. Providers, models, or regions may change to maintain or improve the service, but Mivo will update its disclosure and obtain any permission required before materially different personal data is shared. You may decline or turn AI off without losing local organization features.
4. AI Limitations and Safety
Mivo clearly labels AI interactions. AI is not a person and may be inaccurate, incomplete, biased, or inappropriate. It is not an emergency service, therapist, medical provider, lawyer, or financial adviser, and its output is not professional advice. Do not rely on it for emergencies, diagnosis, treatment, legal rights, financial decisions, or other high-impact decisions. If you or someone else may be in immediate danger, contact local emergency services or a qualified professional. Mivo does not perform human face recognition or know who a person in a photo is.
5. Photo Deletion — Important
Mivo never deletes a library item in the background on its own. A deletion occurs only after you select items and confirm Apple’s system deletion dialog. Deleted media normally moves to the system Recently Deleted album and is generally recoverable there for 30 days, subject to iOS behavior and your settings. Review selections and back up important media before confirming. To the extent permitted by law, the Developer is not responsible for loss caused by deletion choices you knowingly confirm.
6. Mivo Pro
Mivo may offer auto-renewing monthly or annual subscriptions. The price, billing period, trial, introductory offer, taxes, and renewal terms shown in Apple’s purchase sheet control. Apple charges your Apple Account and handles billing and refunds. Unless cancelled through Apple before renewal under Apple’s rules, a subscription renews automatically. Pro features and AI quotas are described in the App and may include reasonable, non-unlimited usage limits needed to control cost, abuse, and availability. Material reductions apply prospectively with reasonable notice where practicable.
7. Acceptable Use
Do not use Mivo to break the law; infringe privacy, publicity, copyright, or other rights; submit content you are not permitted to process; exploit or harm minors; generate or facilitate fraud, abuse, malware, or violence; bypass security, subscriptions, or usage limits; interfere with the App or providers; scrape or resell the service; or reverse engineer it except where law expressly permits. We may restrict abusive requests or suspend access reasonably necessary to protect users, providers, the service, or legal compliance.
8. Privacy and Your Controls
The Privacy Policy is part of these Terms. Mivo has no advertising or cross-app tracking and does not sell personal information. You can turn off AI, clear local and cloud AI memory, revoke photo access, sign out, and permanently delete the Mivo account in the App. Turning off AI withdraws Mivo’s stored AI-sharing permission; the next AI use will ask again. Account deletion does not remove media from your Apple Photos library.
9. Availability, Changes, and Termination
Mivo may add, modify, replace, or discontinue features, providers, models, or limits because of product, security, legal, cost, platform, or provider changes. We aim to give reasonable notice when a material change adversely affects paid features. You may stop using Mivo at any time. We may suspend or terminate access for material breach, fraud, security risk, legal necessity, or provider requirements. Where appropriate, we will give notice and a reasonable opportunity to cure. Sections that by nature should survive termination—including ownership, disclaimers, liability limits, and dispute terms—remain effective.
10. Disclaimers and Liability
Mivo is provided “as is” and “as available.” To the extent permitted by law, we do not promise uninterrupted, error-free, perfectly secure, or universally compatible operation, or that cleanup suggestions or AI output will be accurate. To the extent permitted by law, neither party is liable for indirect, incidental, special, punitive, or consequential damages. The Developer’s aggregate liability arising from Mivo will not exceed the greater of US$50 or the amount you paid for Mivo during the 12 months before the claim. These limits do not apply to fraud, intentional misconduct, gross negligence, personal injury where liability cannot be limited, or any non-waivable consumer right or remedy.
11. Apple Terms
These Terms supplement Apple’s Standard Licensed Application End User License Agreement. Apple is not responsible for operating or supporting Mivo except as required by that agreement or applicable law. If these Terms conflict with Apple’s mandatory App Store terms, Apple’s terms control to that extent. Apple and its subsidiaries are intended third-party beneficiaries where Apple’s standard agreement requires it.
12. Changes, Law, and Contact
We may update these Terms prospectively and will show the new effective date. Material changes will be presented in a reasonably conspicuous way; where consent is legally required, we will ask before the change applies. Applicable law and courts with lawful jurisdiction govern disputes, without taking away mandatory consumer protections. We do not require arbitration or waive class-action rights in these Terms.
